1. Acceptance of Terms

By accessing coatandcanter.com or purchasing products from Coat & Canter, an Ontario corporation ("Coat & Canter", "we", "us", "our"), you ("you", "your", or the "customer") agree to these Terms of Service. These Terms, together with our Privacy Policy and any posted shipping and return policies, form the entire agreement between you and us and supersede all prior communications. We may update these Terms from time to time; the version posted on our website at the time of your order applies to that order.

2. Prices & Order Acceptance

All prices displayed on coatandcanter.com are in Canadian dollars (CAD) unless otherwise indicated, and are subject to change without notice. Applicable taxes (GST/HST/PST/QST) are calculated at checkout based on your shipping address.

We reserve the right to cancel or refuse any order, including in cases of obvious pricing errors, inventory discrepancies, or coupon code miscalculations. If an order total contains an administrative or technical error, we may correct the error and update or cancel the order accordingly. If we cancel an order after payment has been taken, we will issue a full refund to your original payment method.

3. Terms of Payment

Full payment is required at online checkout via credit card, debit card, or an authorized digital payment provider (such as Shop Pay, Apple Pay, or Google Pay). Orders will not be processed or dispatched until we receive full payment authorization. Open credit accounts, trade financing, or line-of-credit terms are not available for online consumer purchases.

4. Title & Security Interest

We retain ownership and title to products until full payment (including shipping fees and applicable taxes) has been successfully processed. If payment is disputed, charged back, or revoked after delivery, you agree to return the unpaid merchandise promptly in its original condition at your expense, or remit full payment upon demand.

5. Risk of Loss & Delivery

All purchases are made pursuant to a shipment contract. Risk of loss passes to you upon delivery of the goods to the carrier at our fulfillment facility. Delivery estimates provided at checkout are estimates only and are non-binding. We are not liable for carrier delays, weather interruptions, or transit disruptions beyond our control. Carrier tracking information constitutes evidence of dispatch.

If your order arrives damaged or does not arrive, please contact us at hello@coatandcanter.com and we will work with you and the carrier to resolve the issue.

6. Intellectual Property

All Coat & Canter brand logos, trademarks, text, graphics, photography, designs, and content displayed on coatandcanter.com are the exclusive property of Coat & Canter. or are used under license from the respective brand owners. You may not alter, remove, reproduce, or misuse any brand identity, tags, or markings on the products or the website without our prior written consent.

7. Warranties & Limitation of Liability

We warrant that, for a period of six (6) months after delivery, products will be free from defects in materials and workmanship. Normal wear and tear is expected and is not covered by this warranty.

If you notify us in writing at hello@coatandcanter.com within six months of delivery of a defect, we will repair or replace the product, or credit the purchase price, at our option.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL OTHER WARRANTIES, CONDITIONS AND REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE DISCLAIMED, AND IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM PRODUCT USE.

Your consumer rights. Nothing in these Terms excludes, restricts or modifies any condition, warranty, guarantee, right or remedy that you have under applicable consumer protection legislation, including the Ontario Consumer Protection Act, 2002, Quebec's Consumer Protection Act, or similar laws in your province or territory, where such rights cannot lawfully be excluded or limited. Where such laws apply, our liability is limited to the extent permitted by those laws.

Warranty claims are void where the defect or damage results from unauthorized modifications, misuse, failure to follow product instructions or care guidelines, or improper fitting of equestrian equipment. Equestrian equipment should be properly fitted to horse and rider; if you are unsure about fit, we recommend consulting a qualified saddle fitter, coach, or equine professional.

8. Safety & Assumption of Risk

Equestrian activities carry inherent risks. Our products are intended to support riders and horses but do not eliminate the risks of equestrian sport. Always use appropriate certified safety equipment, follow manufacturer instructions, and ride within your ability. You are responsible for ensuring products are appropriate, correctly fitted, and properly maintained for your intended use.

9. Indemnification

You agree to indemnify, defend, and hold harmless Coat & Canter, and their officers, directors, and employees, against all claims, liabilities, damages, and costs (including reasonable legal fees) arising out of your misuse of products, failure to follow product directions and warnings, or improper fitting and use of horse or rider equipment, except to the extent caused by our negligence or a defect in the product.

10. Account Termination & Usage Restrictions

We reserve the right to cancel orders, limit quantities, or terminate website access and customer accounts at our discretion if you violate these Terms, engage in fraudulent activity, or initiate unwarranted payment chargebacks.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be subject to the non-exclusive jurisdiction of the courts of Ontario. If you are a consumer, this section does not deprive you of the protection of mandatory consumer protection laws of the province or territory in which you reside.
